Terms of use

1. What Fakeshot is

Fakeshot is a free design tool that makes mockup images that look like phone screenshots. It is meant for fun, memes, jokes between friends, storytelling, design mockups, presentations, videos and similar creative uses. By using Fakeshot you accept these terms. If you don't accept them, please don't use it.

2. Not affiliated with anyone

Fakeshot is an independent tool. It is not made, endorsed or sponsored by Apple, Meta, Instagram, WhatsApp, Facebook, Messenger, Google, Gmail or any other company. Their names are used only to describe which style a mockup imitates. All trademarks belong to their owners.

3. Rules: what you may not do

Images made with Fakeshot are fictional. You may not use Fakeshot, or images made with it, to:

• deceive, defraud or scam anyone, or get money, goods, data or any advantage through deception;
• fake evidence or records for courts, police, employers, schools, banks, insurers, landlords, authorities or anyone else;
• impersonate a real person, company or organisation, or put words in a real person's mouth in a way that could harm them;
• defame, harass, bully, blackmail, threaten or embarrass anyone, or spread false information about a real person;
• break any law, or infringe anyone's rights (including privacy, personality, image and intellectual property rights).

If you share an image made with Fakeshot where people might think it is real, make clear that it is a mockup.

4. You are responsible for what you make

Everything you type or upload, and everything you do with the images, is your sole responsibility. We don't see, check or store your content (see Privacy). You agree to indemnify and hold harmless STUDIO MERLIN, s.p. and its owner against any claims, damages, fines and costs (including reasonable legal fees) caused by your content or by your use or misuse of Fakeshot or its images.

Only upload photos you have the right to use. Don't upload photos of other people without their permission.

5. Provided as is

Fakeshot is free and provided "as is" and "as available", without any warranty. We don't promise that it is error free, always online, accurate, or that images look identical to any real app. We may change, pause or stop Fakeshot at any time without notice. Your work is kept only in your own browser and can be lost at any time, for example when you clear browser data.

6. Liability

To the maximum extent allowed by law, STUDIO MERLIN, s.p. is not liable for any direct or indirect damage, loss of data, loss of profit, or any other harm arising from using or not being able to use Fakeshot, from errors or bugs, or from what you or other people do with images made with it. Since Fakeshot is free, any liability that cannot be excluded is limited to the amount you paid us, which is zero.

Nothing in these terms limits liability that cannot be limited under applicable law, such as liability for intent or gross negligence, for harm to life, body or health caused by our fault, or your mandatory rights as a consumer.

7. Our content

The Fakeshot name, design, code and icons belong to STUDIO MERLIN, s.p. You may use the images you make, within these terms. Please don't copy the tool itself. Fonts are used under their open font licences.

8. Law and changes

Slovenian law applies, and the courts of Slovenia have jurisdiction, without taking away mandatory consumer protections of your own EU country. If one part of these terms is invalid, the rest stays valid. We may update these terms; the date below shows the current version.

Privacy

What we collect

Nothing you make. Your texts, names and photos are processed only inside your own browser. They are never uploaded to our server. The finished picture is created on your device too.

To remember your work between visits, Fakeshot saves it in your browser's local storage on your device. You can delete it any time by clearing this site's data in your browser. There is no account, no tracking, no analytics, no ads and no cookies.

Server logs

Like every website, our server receives technical data when it sends you the page (IP address, time, browser type). This is used only to deliver the site and keep it secure (legitimate interest, GDPR Art. 6(1)(f)) and is deleted after a short time. It is not used to identify you or shared with anyone, except our hosting provider Hostinger (Germany, EU), which processes it on our behalf.

Your rights

Under the GDPR you can ask for access, correction, deletion or restriction of your personal data, and you can object to processing. Write to tassh@studio-merlin.com. You can also complain to the Slovenian data protection authority: Informacijski pooblaščenec, Dunajska cesta 22, 1000 Ljubljana, www.ip-rs.si.

Age

Fakeshot is meant for people aged 15 or older.
